Did you know that most Pooled Special Needs Trusts keep a portion of the funds that are remaining in the trust when the beneficiary passes away? Legacy Enhancement gives the beneficiary a choice. They can leave the funds in the trust to be used for the benefit of others within the trust who have also chosen to leave their funds within the trust, OR they can choose to pay back the state(s) Medicaid office first and all remaining proceeds will be paid to a named beneficiary of their choosing. The claimants get the right to choose up-front where any remaining proceeds will go and to whom they will benefit in the future upon their death.
That beneficiary will receive all remaining funds after payback to the state(s). Legacy Enhancement does not keep any portion of the remaining balance.
